The Transformation of the Administrative Judge’s Function in the Context of Automated Administrative Justice in Morocco

This paper investigates the fundamental transformation of the administrative judge's role driven by the accelerating automation of justice. While algorithmic systems enhance judicial efficiency by reducing adjudication timeframes and alleviating routine administrative burdens, they generate complex challenges, notably the risk of automated bias and the difficulty of auditing the algorithmic "black box." Consequently, the judge's function is evolving from traditional dispute resolution to the scrutiny of the automated logic underlying decisions. Drawing upon a comparative approach, the study concludes that establishing a legislative framework and amending procedural laws are imperative to regulate the use of artificial intelligence in courts. This approach ensures a delicate balance between technological efficiency, fair trial guarantees, and the principle of legality.
